Labour Appeal Court

The Labour Appeal Court is located in Braamfontein, Johannesburg, but appeals are also heard in Cape Town, Durban and Port Elizabeth. Every appellant who has a right of appeal must deliver a notice of appeal within 15 days after leave to appeal has been granted.

The appeal record must be lodged within sixty (60) days from the date of the order granting leave to appeal unless the appeal is noted after a successful petition for leave to appeal, in which case the record must be delivered within the period fixed by the court under Rule 4(9). Cases are decided on the record of the proceedings as it was before the Labour Court.

This record has to be prepared strictly in accordance with the Labour Appeal Court rules. All irrelevant and formal documents have to be excluded. After perusing the record, and considering the written and oral arguments presented, a written judgment is handed down.
